Do divorcing wives get a better deal 'down South'?

Practice area: Family

According to law firm research published in the national media recently, they frequently do.

Fiona Bethel, who heads the Kester Cunningham John family team, says:

"I would certainly endorse some of the findings of the research - there are variations from one court to another and between one judge and another. The fact that judges have discretion in divorce cases is essential because a 'one size fits all' approach is only valid in the most straightforward divorces. However, while an individual judge will seek to operate consistently, getting consistency between judges who sit in different courts is much harder.

The research does not mean, however, that all divorcing men should suddenly rush up to Newcastle in search of legal advice - the important decision is finding a solicitor who has the right expertise to help in your particular circumstances. Many divorces are settled without a judge needing to make a decision at all, for instance where a couple chooses the Collaborative Law route, or where agreement can be reached between the spouses with the help of their solicitors before the case goes to court. Getting the right solicitor is more important than getting the right court.
