Did Katie Price and Alex Reid make a Pre-Nuptial agreement?
Practice area: Family
As far as we know at the moment, the answer is 'no'. Given that legal advice should be taken by both parties independently more than 21 days before the marriage in order for a Pre-Nup to be drawn up, it seems highly unlikely that they did so given Alex's recent stint in the Celebrity Big Brother house.
As Katie is estimated to be worth around £50m, while Alex is undoubtedly less well off, most commentators will agree that she would have been prudent to do so. If the couple break up in the future, with no agreement in place, it is highly likely that he will walk away with a considerable slice of her wealth.
Her lawyers will now almost certainly be encouraging her to make a Post-Nuptial Agreement. A Post-Nuptial Agreement is very similar to a Pre-Nuptial Agreement apart from the fact that it is negotiated and signed after the wedding has taken place and not before. As with a Pre-Nuptial Settlement, provided the agreement is fair to both parties, there has been financial disclosure and appropriate legal advice the Courts will take notice of Post-Nuptial Agreements should the couple later on divorce. Hopefully, the fact that a Post-Nuptial Agreement has been reached in the first place avoids any need for litigation and in the event of separation the parties are already clear about how their financial assets and liabilities will be divided.
Both Pre-Nuptial and Post-Nuptial Agreements are becoming increasingly popular among people who have previously been married as a way of ensuring that should they divorce in the future there are limited arguments about how the assets are divided.
